Hello, Friends,

I was contacted by Cheri Battrick and Arthur Taylor about an initiative they are starting to get a 6,000-signature petition for the April 2023 ballot. The information is below which details what the voters would approve, to make Independence a refuge and Constitutional rights sanctuary city in the event our national government is compromised and no longer functions. Independence, Missouri: A Constitutional Sanctuary City

During this unsettling time in our nation’s history, a group of concerned citizens is working to do something to ensure that the rights of the residents of Independence, Missouri, will not be lost in the event of a breakdown of the national government.

The initiative petition they will be circulating needs approximately 6,000 signatures of voters who are registered in Independence so it can be placed on the April 2023 ballot. If it appears on the ballot and is approved by the voters, Independence will become a refuge and sanctuary city for those desiring to maintain their Constitutional rights.

This initiative includes four main sections:
Reaffirming the Bill of Rights as contained in the US Constitution
Guaranteeing the Bill of Rights and all the remaining provisions of the US Constitution will stay in effect if there is a breakdown of the US government.
Implementing a new Community Bill of Rights to protect children, families, and religious liberty to a greater degree.
Providing election integrity provisions in Independence to ensure free and fair elections.

Arthur Taylor, one of the organizers for the group promoting the petition stated: “We are in difficult times. The Constitution must be preserved. We must look ahead and be prepared for any eventuality. With the approval of this initiative, Independence will be a safe refuge for those seeking to live peacefully according to the protections of Constitutional law.”

The US Constitution guarantees us many rights such as life, liberty, and the pursuit of happiness. The Bill of Rights, provides specific protection for the right to bear arms (keep and bear arms), freedom of religion (to worship as we believe), freedom of speech (the ability to communicate without censorship), and protection from unreasonable search and seizure. It also provides protection for those involved in legal disputes heard by the court system so that the laws will be applied consistently and universally to all.

As current events escalate and become more troubling, maintaining our individual rights will be essential to our peace, safety, and emotional well-being.

What is the Constitutional Sanctuary City Initiative Petition about?

The City of Independence, Missouri will receive to certify for circulation an initiative petition amending its charter which will:

1) Protect the Bill of Rights;
2) Protect the Constitution;
3) Establish a Community Bill of Rights protecting religious liberty, family, and children; and
4) Provide that election integrity measures be followed to ensure free and fair elections.

The initiative petition is a first of its kind throughout the US establishing Independence Missouri as a Constitutional Sanctuary City. The protection of the full US Constitution will be triggered by any of five specific events or circumstances. These triggers are if the United States:

(a) ceases to have acceptance of the most recent national election results across all fifty states or ceases to hold or postpones a national election for more than 45 days; OR
(b) allows a past or present invasion of its border for more than 45 days; OR
(c) declares martial law; OR
(d) sends or receives more than two nuclear missiles; OR
(e) ceases to exist or function.

Events which destroy the Constitutional governmental power of the United States would still leave state and local governments in place. But without a Constitutional trigger law the protections of Constitutional rights would be lost.

What does the phrase “trigger law” mean?

It means the protection provided to the Constitution does not become effective until the “trigger” occurs. In this case, that trigger occurs when the United States of America (a) has election acceptance or election credibility collapse, (b) is invaded for more than 45 days, (c) declares martial law, (d) receives or sends more than two nuclear missiles, or (e) ceases to function.

So, the entire initiative petition is not effective until the trigger occurs?

No. Only the protection of the full US Constitution (beyond the Bill of Rights) requires a trigger before becoming effective. The Bill of Rights, election integrity measures, religious liberty, and other provisions become effective upon passage of the initiative petition by the voters of Independence. No trigger is required for them, and they are still subject to current US Supreme Court decisions.

Why include the Bill of Rights in the City charter if they are already in the U.S. Constitution?

By including the Bill of Rights in the city charter reliable and equal application of these rights can be assured in Independence, regardless of what the Federal Government does and regardless of what happens to the Federal Government. If instability increases in the Federal Government, these vital rights will still be reliably protected at the City level.

What is included in the Bill of Rights?

They are nearly identical to the original Bill of Rights. Specifically, the last two rights (9 and 10) reference the City of Independence and its charter rather than the original language with referenced the United States of America. Some of the key rights in the Bill of Rights include:

1) Right to bear arms (keep and bear arms)
2) Freedom of religion (to worship as we believe)
3) Freedom of speech (to communicate without censorship)
4) Freedom from unwarranted searches and seizures (by our own government, without a warrant)

What are the election integrity provisions?

1.Only paper ballots are allowed in elections within the City of Independence;
2.Vote totals shall be reported every two hours following poll closings.

What do the religious liberty provisions do?

They protect religious speech and religious worship. They protect religion from ongoing governmental restrictions. Currently religious liberty is under increasing attack, and these provisions provide protection in the City of Independence.

What is the Community Bill of Rights?

It incorporates Missouri statutes regarding family, marriage, and children into the City of Independence Charter. In addition, parental rights are strengthened. Governmental electronic searches and seizures are protected against.

Isn’t a Constitutional Sanctuary City new?

Sanctuary cities are not new. But a Constitutional Sanctuary City is. Individuals will be able to find refuge and safety in Independence where all can live in peace under Constitutional law.

What does it mean if I sign the petition?

It only means that you want to have the petition submitted to the voters for approval or rejection. It doesn’t mean that you are either in favor or against the actual petition.

Do you need money?
